HURT2HEALING TERMS OF USE

- About These Terms
These Terms of Use (“Terms”) are an agreement between you and Take Back The Night Foundation (TBTNF), a Delaware nonprofit corporation operating the Hurt2Healing program (“Hurt2Healing,” “we,” “us,” or “our”).
These Terms govern your access to and use of:
- www.takebackthenight.org;
- any Hurt2Healing mobile applications;
- any Hurt2Healing online forms, messaging tools, and digital resources; and
- any other online services that link to these Terms.
Together, these are called the “Services.”
These Terms do not govern third-party websites or services, even when we link to them.
- Agreement to These Terms
By clicking “I Agree,” submitting a form that links to these Terms, creating an account, downloading an application, or otherwise using the Services after being presented with these Terms, you agree to be bound by them.
If you use the Services on behalf of an organization, you represent that you have authority to bind that organization to these Terms.
If you do not agree to these Terms, do not create an account, submit a form, or continue using the affected Service.
- Supplemental Terms
Some Services may have additional terms or notices. For example:
- The Hurt2Healing Workshops are governed by the terms on TBTNF’s website.
- Our handling of personal information is described in the [PRIVACY NOTICE on TBTNF’s website].
- Purchases, donations, or recurring contributions may be subject to terms presented during checkout.
If supplemental terms conflict with these Terms, the supplemental terms control only for the Service to which they apply.
- Emergencies and Immediate Danger
The Services are not an emergency dispatch service and may not be monitored continuously.
If you or another person is in immediate danger, contact 911 or the appropriate emergency service where you are located, if it is safe to do so. In the United States, people experiencing a suicide or mental-health crisis may call or text 988.
Using a form, email address, chat feature, or other Service does not guarantee an immediate response. Any stated response time is an estimate unless we expressly promise otherwise in writing.
Please consider your safety before using a shared device or an account that another person may be able to access.
- Nature of the Services
The Services may provide educational information, advocacy resources, referrals, peer support, or ways to request assistance.
Unless we expressly state otherwise in a separate written agreement:
- the Services do not provide medical diagnosis or treatment;
- the Services do not provide legal representation or individualized legal advice;
- submitting a legal-intake or referral form does not create an attorney-client relationship;
- using the Services does not create a therapist-client or other licensed professional relationship; and
- we do not guarantee that a particular service, professional, referral, or resource will be available or suitable for you.
Nothing in this section limits any professional or confidentiality obligation that applies after Hurt2Healing or another provider expressly accepts a person as a client.
- Eligibility and Young Users
You may use the Services only to the extent permitted by applicable law.
If you are under the age of majority where you live, your ability to agree to contractual terms or consent to particular services may be limited. Nothing in these Terms is intended to prevent a minor from receiving confidential victim services without parental or guardian consent when applicable law permits the minor to do so.
The Services are not directed to children under 13 unless a specific Service clearly says otherwise. A child under 13 should not create an account or submit personal information through a general-audience Service unless Hurt2Healing has specifically authorized that use and implemented the legally required consent process.
Where parental or guardian involvement is legally required, Hurt2Healing will follow applicable law. A parent, guardian, or other person may not authorize disclosure of a young person’s information when that person is prohibited from doing so by law, including because that person is an alleged abuser.
Additional requirements for young users should be described in the Privacy Notice and any applicable service-specific notice.
- Privacy and Confidentiality
The TBTNF Privacy Notice explains what personal information we collect, why we collect it, how we use and disclose it, how long we retain it, and the choices available to you.
Because information submitted through the Services may be highly sensitive:
- do not place personal or confidential information in a field identified as public;
- review the privacy and confidentiality notice displayed with a form before submitting it;
- provide only the information reasonably necessary for your request; and
- contact us using the method listed below if you have questions before submitting sensitive information.
We handle victim information in accordance with applicable law and our confidentiality policies. Depending on the Service and applicable law, disclosure may be permitted or required in limited circumstances, including pursuant to a valid legal mandate or a mandatory-reporting obligation. The applicable form or notice should explain material confidentiality limits before information is collected.
Agreeing to these Terms is not consent to disclose personally identifying victim information and is not a release of confidential records.
When applicable law requires a release, Hurt2Healing will use a separate written authorization that identifies:
- the information to be disclosed;
- the person or organization receiving it;
- the purpose of the disclosure; and
- the period during which the authorization remains effective.
Signing such a release will not be made a condition of receiving services except where a particular disclosure is legally permitted and genuinely necessary to fulfill the person’s specific request.
No Internet transmission or storage system can be guaranteed to be completely secure. We nevertheless use safeguards designed to protect information as required by applicable law. Report suspected privacy or security problems to legal@takebackthenight.org.
- Accounts and Account Security
If a Service permits you to create an account, you agree to provide information that is accurate to the best of your knowledge and to keep your login credentials reasonably secure.
You are responsible for activity conducted through your account unless it results from Hurt2Healing’s failure to meet an applicable legal or contractual obligation. Notify us promptly at legal@takebackthenight.org if you believe your account or information has been accessed without authorization.
We may require identity or authority verification before providing access to sensitive records. Any verification procedure will be designed with user privacy and safety in mind.
- Limited License
Subject to these Terms, Hurt2Healing grants you a limited, nonexclusive, nontransferable, and revocable license to access and use the Services for their intended, lawful purposes.
Unless a resource states otherwise, you may download or print Hurt2Healing educational materials for your personal, educational, or other noncommercial use, provided that you do not remove copyright, attribution, or safety notices.
You may not reproduce, sell, sublicense, modify, distribute, or commercially exploit Hurt2Healing content except as expressly permitted by us in writing or allowed by law.
Separate open-license terms displayed on a particular resource control over this section.
- Intellectual Property
The Services and the text, graphics, designs, software, audio, video, trademarks, logos, and other materials provided by Hurt2Healing (“Hurt2Healing Content”) are owned by or licensed to Take Back The Night Foundation and are protected by applicable intellectual-property laws.
These Terms do not transfer ownership of Hurt2Healing Content or grant permission to use Hurt2Healing’s names, logos, or trademarks except as necessary to identify or use the Services as intended.
Third-party names and materials remain the property of their respective owners.
- Information You Submit
You retain any ownership rights you have in information or materials you submit through the Services (“User Content”).
You give Hurt2Healing permission to host, secure, reproduce, and process User Content only as reasonably necessary to:
- provide the Service or assistance you request;
- maintain and secure the Services;
- comply with applicable law; and
- exercise or defend legal rights where legally permitted.
This permission does not authorize Hurt2Healing to publicly disclose, advertise with, sell, or otherwise use personally identifying victim information in a manner prohibited by applicable law, the Privacy Notice, or Hurt2Healing’s confidentiality obligations.
If we wish to publish a testimonial, story, photograph, recording, or other identifying material, we will obtain separate permission that clearly describes the proposed use. You are not required to provide such permission to receive services.
Do not submit material that you do not have the right to provide. However, this restriction does not prevent you from sharing information about abuse, harassment, threats, exploitation, or other conduct for the purpose of seeking help, reporting a concern, or obtaining services.
- Acceptable Use
You may not use the Services to:
- violate applicable law;
- threaten, harass, exploit, stalk, or impersonate another person;
- interfere with another person’s access to support or services;
- access another person’s account or confidential information without authorization;
- collect information about other users without lawful authorization;
- introduce malware or interfere with the operation or security of the Services;
- evade access or security controls;
- submit content that unlawfully infringes another person’s rights; or
- use the Services for trafficking, exploitation, retaliation, or other harmful conduct.
We may investigate suspected misuse and may preserve or disclose information when permitted or required by law. Any action involving victim information remains subject to applicable confidentiality protections.
- Third-Party Services and Referrals
The Services may link or refer you to independent organizations, professionals, applications, or websites. Unless expressly stated otherwise, those third parties are not controlled by Hurt2Healing and have their own terms, privacy practices, qualifications, and service standards.
A link or referral does not constitute a guarantee or endorsement. You should evaluate whether a third-party service is appropriate and safe for your circumstances.
Service providers that process information on Hurt2Healing’s behalf are addressed in our Privacy Notice and are required to protect information as provided by applicable law and their agreements with us.
- Payments, Purchases, and Donations
Prices, recurring-payment terms, refund rules, and any restrictions applicable to a purchase or donation will be disclosed before the transaction is completed.
Payments may be processed by an independent payment processor. Hurt2Healing does not receive or store complete payment-card information when the processor handles that information directly.
A donation’s tax treatment depends on applicable law and the donor’s circumstances. A receipt from Hurt2Healing is not tax advice.
Our refund or cancellation policy is available on the TBTNF website.
- Copyright Concerns
If you believe material available through the Services infringes your copyright, send a notice to:

The notice should identify the copyrighted work, the allegedly infringing material, your contact information, and the basis for your claim.
- Service Availability and Changes
We may modify, suspend, or discontinue a feature when reasonably necessary for safety, security, maintenance, legal compliance, funding, or program operations.
We do not promise that every Service will always be available, uninterrupted, or error-free. When practical, we will provide notice of a material discontinuation and information about available alternatives.
- Suspension and Termination
We may restrict or terminate access to an account or interactive feature when we reasonably believe it is necessary to:
- address a safety or security risk;
- prevent unlawful or materially harmful conduct;
- protect users or staff;
- comply with law; or
- respond to a material violation of these Terms.
When appropriate, we will provide notice and an opportunity to contact us about the decision. We will not retaliate against a person for making a good-faith complaint, requesting an accommodation, or asserting a legal right.
Termination does not eliminate rights or obligations that, by their nature, should continue, including confidentiality, intellectual-property ownership, and provisions addressing disputes arising before termination.
- Disclaimers
To the fullest extent permitted by law, the Services and Hurt2Healing Content are provided “as available.” We do not guarantee that all information will be complete, current, or appropriate for every person or situation.
We disclaim implied warranties only to the extent the law permits. Nothing in these Terms disclaims:
- duties that cannot legally be waived;
- obligations expressly stated in these Terms or the Privacy Notice;
- applicable victim-confidentiality obligations; or
- responsibility for fraud, gross negligence, willful misconduct, or other liability that cannot legally be excluded.
Some jurisdictions do not permit certain warranty exclusions, so portions of this section may not apply to you.
- Limitation of Liability
To the fullest extent permitted by law, neither Hurt2Healing nor Take Back The Night Foundation will be liable for indirect, incidental, special, exemplary, or consequential damages arising from use of the Services.
This limitation does not apply to liability arising from:
- gross negligence or willful misconduct;
- death or personal injury to the extent caused by legally actionable conduct;
- violation of applicable privacy or victim-confidentiality obligations;
- infringement or misappropriation of another person’s intellectual-property rights; or
- liability that applicable law does not permit us to limit.
Because jurisdictions differ, counsel should determine whether an additional monetary cap is lawful and appropriate. No monetary cap applies unless one is inserted here after that review.
- Organizational Users
If you use the Services on behalf of a business or organization, that organization agrees to defend and indemnify Take Back The Night Foundation against third-party claims resulting from the organization’s unlawful use of the Services or its infringement of another person’s rights.
This section does not require an individual seeking information, advocacy, or survivor services for personal purposes to indemnify Hurt2Healing for ordinary use of the Services.
- Governing Law and Disputes
These Terms are governed by the laws of the State of Delaware, without regard to conflict-of-law principles.
Any court proceeding relating to these Terms must be brought in the state or federal courts located in New Castle, Delaware, unless applicable consumer law gives you the right to bring the proceeding elsewhere.
Before filing a non-urgent dispute, you and Hurt2Healing agree to make a reasonable good-faith effort to resolve it by contacting legal@takebackthenight.org. This requirement does not prevent either party from seeking emergency, protective, injunctive, or other time-sensitive relief.
These Terms do not require arbitration and do not waive participation in a class action.
Nothing in this section deprives you of protections that cannot be waived under the law where you live.
- Changes to These Terms
We may update these Terms from time to time. We will post the revised Terms with a new effective date.
For material changes, we will provide reasonable advance notice through the Services, by email when appropriate and safe, or by another reasonable method. We will seek affirmative consent when required by law.
Changes apply prospectively and do not alter the terms governing a dispute that arose before the new effective date. If you do not agree to revised Terms, you may stop using the affected Service.
- Electronic Communications
When you provide contact information and ask us to communicate with you, you consent to receive communications using the method you selected.
Because communications about survivor services can create safety risks, we will follow any communication preferences or safety instructions collected through the applicable Service. You may update those preferences by emailing legal@takebackthenight.org.
Administrative messages necessary to operate an account may still be sent where permitted by law.
- Accessibility
Hurt2Healing seeks to make its Services accessible to people with disabilities and to people who use assistive technologies.

We will not require a person to disclose more disability-related information than is reasonably necessary to address the request.
- General Provisions
These Terms and any applicable supplemental terms constitute the entire agreement concerning the Services they govern.
If a provision is found unenforceable, it will be enforced to the maximum extent permitted, and the remaining provisions will remain in effect.
A failure to enforce a provision once is not a waiver of the right to enforce it later.
You may not transfer contractual rights under these Terms to another person without our consent. We may transfer these Terms as part of a merger, reorganization, or transfer of the Hurt2Healing program, subject to applicable confidentiality and privacy requirements.
Headings are provided for convenience and do not change the meaning of these Terms.
